Terms and conditions of sale and use

Terms applicable to subscribing to and using the Pilotafrik service.

1.Purpose

These general terms govern the sale and use of the Pilotafrik service, an online platform for managing cash-on-delivery e-commerce operations.

Subscribing to any plan, including the free trial, entails unreserved acceptance of these terms. They prevail over any other document, save written agreement to the contrary.

2.Description of the service

The service allows a merchant to centralise their orders, track their status through to collection, organise the work of their closers and couriers, and reconcile revenue against costs.

The service is provided online, accessible through a browser. It includes neither delivery services, nor collection on behalf of third parties, nor any payment-institution activity: the financial flows tied to orders remain entirely in the merchant's hands.

3.Plans and pricing

The available plans and their prices are as follows. Prices are expressed in CFA francs (XOF).

  • Trial — Free · 7 days, no credit card
  • Solo — 5,000 FCFA / month · 1 store, capped order volume
  • Unlimited — 10,000 FCFA / month · Unlimited stores and orders
  • 6-month licence — 25,000 FCFA · Prepaid Solo plan
  • 1-year licence — 50,000 FCFA · Prepaid Solo plan

4.Free trial

Every new sign-up is entitled to a free 7-day trial giving access to the features of the service. No credit card is required.

At the end of the trial, access to the service is suspended until a paid plan is subscribed. Data entered during the trial is retained under the conditions set out in the privacy policy.

5.Subscription and payment

Access to the subscribed plan is activated once payment has actually been received. Monthly plans are due per one-month period; the 6-month and 1-year licences are paid in a single instalment and cover the corresponding term.

The publisher reserves the right to change its prices. Any change has no effect on a period already paid for and is communicated to the customer before renewal.

6.Term, renewal and termination

The subscription is taken out for the term of the chosen plan and ends at its expiry unless renewed. There is no automatic renewal by direct debit: renewal requires a new payment.

The customer may stop using the service at any time. Requests to delete the account and its data follow the procedure described in the privacy policy.

7.Account suspension

The publisher may suspend access to an account in the event of non-payment at the due date, use contrary to these terms, or use liable to compromise the security or stability of the service.

Except in a security emergency, suspension is preceded by notice to the customer. It gives rise to no refund where it results from a breach by the customer.

8.Customer obligations

The customer is responsible for the accuracy of the information they provide, for the confidentiality of their credentials and of those they create for their team members, and for the use of the service by those members.

The customer warrants that they have the right to process the data they import into the service, in particular the personal data of their own customers, and undertakes to process it in accordance with the applicable regulations.

9.Availability and support

The publisher takes reasonable steps to ensure the availability of the service, without guaranteeing the complete absence of interruption. Interruptions may occur for maintenance or because of third-party services on which the platform depends.

10.Liability

The service is a management aid. Commercial, accounting and tax decisions taken on the basis of the information it presents are the sole responsibility of the customer.

The publisher cannot be held liable for indirect losses, in particular loss of revenue, of customers or of data resulting from a failure by the customer to meet their own backup and security obligations.

11.Governing law and disputes

These terms are governed by the law in force in [TO FILL — country / competent jurisdiction].

In the event of a disagreement, the parties will endeavour to reach an amicable solution. Failing agreement within a reasonable time, the dispute will be brought before the competent courts of [TO FILL — country / competent jurisdiction].
